By accessing or using Kombine (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

## 1. Our Services

Kombine is a personal productivity application providing a Pomodoro timer, task management, and activity tracking across multiple devices. The Service is provided as-is for personal, non-commercial use.

The information provided by the Service is not intended for distribution in any jurisdiction where such use would be contrary to law or regulation.

## 2. Intellectual Property

All content, source code, functionality, and design of the Service are owned by Adam Świderski and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, sell, or otherwise exploit any part of the Service without prior written permission.

## 3. Your Account

To use the Service, you may be required to register an account. You are responsible for:

- Providing accurate and complete information
- Keeping your credentials secure
- All activity that occurs under your account

You must notify us at kombine@swiderski.tech of any unauthorized use of your account.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service.

You may not use the Service to:

- Violate any applicable law or regulation
- Attempt to reverse engineer, decompile, or disassemble the Service
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to any part of the Service
- Use automated tools (bots, scrapers, scripts) against the Service
- Impersonate another person or entity
- Transmit malware, viruses, or other harmful code

## 5. User Submissions

If you send us feedback, suggestions, or ideas ("Submissions"), you agree that we may use them freely without compensation or acknowledgment. You retain ownership of any content you create within the app itself (tasks, notes, etc.), which remains stored locally on your device.

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable for any loss resulting from unavailability of the Service.

## 7. Disclaimer of Warranties

The Service is provided **"as is"** without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.

## 8. Limitation of Liability

To the fullest extent permitted by applicable law, Adam Świderski shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

## 9. Term and Termination

These Terms remain in effect while you use the Service. We reserve the right to terminate or suspend your access at any time, without notice, for breach of these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately.

## 10. Governing Law

These Terms are governed by the laws of **Poland**. You irrevocably consent to the exclusive jurisdiction of the courts of **Poland** for any dispute arising from these Terms.

## 11. Dispute Resolution

**Informal negotiation:** Before initiating any formal proceedings, both parties agree to attempt to resolve disputes informally by contacting us at kombine@swiderski.tech and allowing **30 days** for informal resolution.

**Arbitration:** If informal resolution fails, disputes shall be referred to and finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber (Belgium, Brussels, Avenue Louise, 146). The number of arbitrators shall be **one (1)**. The seat of arbitration shall be **Warsaw, Poland**. The language of proceedings shall be **English**. The governing substantive law shall be the law of **Poland**.

**Restrictions:** Arbitration shall be limited to disputes between the parties individually. No class actions or representative proceedings are permitted.

## 12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting, indicated by an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance.
